LEGAL AUTHORITY FOR CREATION AND OPERATION(State)
Created under an act of the State Legislation in 1967 H.B. 373, Chapter 601 at p. 1381; Texas Tax Code. Section 311.005(a)(5); as amended in 1985 by S.B. 1377, Chapter 674 (p. 5081) under the provisions of Section 59 of Article XVI of the Texas Constitution.
GENERAL POWER AND DUTIES
The Authority is created as a conservation and reclamation district and a political subdivision covering southwest Liberty, southwest Chambers and all of Harris Counties. The primary purpose is to provide an agency to finance and construct a water conveyance and distribution system to transport surface water from Lake Livingston and the Trinity River to the named counties.
MEETING TIME AND LOCATION
The second Wednesday of the month, 10:00 a.m.; One Allen Center, 500 Dallas St, Suite 2800.
COMPOSITION
The management and control of Authority is hereby vested in a board of seven directors who shall be at least twenty-one years of age and shall be residents of landowners of Harris County or that part of Chambers and Liberty Counties which are within the boundaries of the Authority. Incorporated cities within Harris County, such as Bellaire, the Villages or West University Place, are not excluded from consideration. No member of the City Council or any employee of the City of Houston shall be appointed as a director.
Four of such directors and their successors, being positions numbered one to four inclusive, shall be appointed by the Mayor of the City of Houston with the advice and consent of the City Council. Any director appointed by the Mayor or Governor shall be entitled to serve as a director pending his approval by the City Council or Senate.
Four are City appointments.
Positions 1 through 4. Are nominated by the Mayor and confirmed by City Council.
Positions 5 through 7. Are nominated by the Governor and confirmed by the Senate.
Position 5. Belongs to Chambers County.
Position 6. Belongs to Liberty County.
Position 7. Belongs to Harris County.
TERM: A person who is elected office in the Authority shall serve for two years in that capacity or until he ceases to be a director, if this event occurs within two years.
CHAIRPERSON: The Authority shall reorganize and elect from its members a president, vice-president, secretary-treasurer. At its April meeting of each year the Authority shall elect officers for the offices to be filled. If a vacancy occurs in an Authority office, the directors at the next regular Authority meeting shall elect a person to serve until the next April meeting of the Authority.
FINANCIAL ACCOUNTABILITY
Entity is NOT included in the financial reporting for the City of Houston. Required to take an Ethics Course.
