LEGAL AUTHORITY FOR CREATION AND OPERATION(City)
City of Houston, Fire Code, Sections 108.1, A 101.2 (Appendix A).
GENERAL POWER AND DUTIES
The duties of the Board of Appeals shall be as follows:
1. To recommend changes in the Fire Code to the Mayor.
2. To provide for reasonable interpretations of the Fire Code.
3. To hear appeals from written decisions of the Fire Marshal as to the suitability of alternative materials and types of construction.
4. In-cooperation with the Fire Marshal, to submit an annual report to the Mayor and City Council containing a summary of the actions of the Board during the preceding year.
MEETING TIME AND LOCATION
The Fourth Tuesday of the month, 2:00 p.m.; Fire Marshal's Office, 2931 West 12th Street, Conference Room.
COMPOSITION
TOTAL: 11 members, with the exception of the Fire Chief, the Code Official (Fire Marshal), and the Director of Planning and Development, members of the board shall be appointed by the Mayor, subject to confirmation by the City Council.
Position 1: A well-respected citizen of the jurisdiction.
Position 2: The Code Official (Fire Marshal) or duly authorized representative, who shall provide a Board secretary.
Position 3: The Fire Chief or duly authorized representative.
Position 4: The director of Planning and Development or representative.
Position 5: A well-respected citizen of jurisdiction, to serve as chairperson.
Position 6: A professional engineer registered as such under the laws of Texas, who shall be actively engaged in the practice as a fire protection engineer.
Position 7: A person who is a member of the Building Owners and Managers Association of Houston.
Position 8: A person who is engaged or employed in the chemical or petroleum industry.
Position 9: A Houston Apartment Association member.
Position 10: A fire protection contractor.
Position 11: A person who is an architect registered by the State of Texas
NOTE: The City of Houston Legal Department shall have an attorney present for each board meeting, who shall advise the Board on legal matters relative to topics under board jurisdiction.
COMPENSATION: Each member of the board shall be compensated at the rate of $50.00 per diem for each meeting the member attends and at which a quorum is present; provided, however, no member shall be paid for more than three meetings in any one month. A jurisdiction employee who is a member of the board shall be paid only for those meetings that the employee attends at which a quorum is present and that are not held during, or that continue beyond, the employee’s regular working hours.
QUORUM: Five members at a meeting shall constitute a quorum.A majority of the members present, constituting a quorum shall conduct business.

TERM: Two years. The terms of the appointees for Positions one, six, seven, and nine commence on January 1 of each odd-numbered year and end on December 31 of the following even-numbered year. The terms of the appointees for Positions five, eight, ten and eleven commence of January 1 of each even-numbered year and end on December 31 of the following odd-numbered year. Members shall hold over until a successor is appointed and qualified.
CHAIRPERSON: The chairperson will be whoever is appointed to Position five.
FINANCIAL ACCOUNTABILITY
Entity is NOT included in the financial reporting for the City of Houston.
