LEGAL AUTHORITY FOR CREATION AND OPERATION(City)
Texas Local Government Code, Chapter 143. Meet & Confer Agreement between the City of Houston and the Houston Police Officers Union, Article 15 (2001 Agreement with the 2003 & 2004 Amendments).
GENERAL POWER AND DUTIES
The POCSC shall succeed to all the authority, responsibilities and duties presently resposed in the Fire Fighters' and Police Officers' Civil Service Commission for the City of Houston as it relates to Police Officers. The Police Officers' Civil Service Commission will have jurisdiction over appeals of disciplinary actions, Step IV appeals of grievances, and all other duties associated with the classification system, promotional system medical and psychological (fitness for duty) separations and the compensation systems of classifed officers set out in the City Charter, the Code of Ordinances and Chapter 143 of the Texas Local Government Code. The Fire Fighters' and Police Oficers' Civil Service Commission will continue to hear and review all the matters subject to jurisdiction under this Agreement until December 31, 2001, when they shall be taken over by the POCSC.
MEETING TIME AND LOCATION
First and Third Thursday of the month, 611 Walker, Fourth Floor, at 8:30 a.m.
COMPOSITION
TOTAL: Minimum of 12 members, maximum of 15 members, appointed by the Mayor.
NOTE: If a vacancy occurs or if an appointee fails to qualify within twenty calendar days after the date of appointment, the Mayor shall appoint another person to serve for the remainder of the unexpired term.
A person appointed to the POCSC must:
1. Be of good moral character
2. Be a United States citizen
3. Be a resident of the City of Houston; or live within 30 miles of the City limits
4. Be at least 30 years of age
5. Not have held a municipal public office within the preceding three years
6. Not have been an employee of the City of Houston or the Union within the preceding ten years
7. Not have a direct conflict of interest with the Union or the City of Houston (Note: A lawyer employed with a firm of over thirty licensed attorneys will not be disqualified or considered to have a conflict of interest just because someone in his/her firm represents the Union or the City).
8. No previous member of either the Municipal Employees’ Civil Service Commission or the Fire Fighters’ and Police Officers’ Civil Service Commission is eligible.
TERM: Three years.
CHAIRPERSON: Elected by membership, in addition to a vice chairperson, both seving terms of 1 year. HR Director serves as the Secretary of the commission.
QUORUM: 3 person panels, 2 people establish quorum.
COMPENSATION: Not specified.
FINANCIAL ACCOUNTABILITY
Entity is NOT included in the financial reporting for the City of Houston.
