LEGAL AUTHORITY FOR CREATION AND OPERATION(City)
Chapter 609 of the Texas Government Code. City of Houston Ordinance No. 2002-0403.

GENERAL POWER AND DUTIES
The duties of the Committee are as follows:

1. To review and determine unforeseen emergency appeals filed by Participants.

2. To recommend investment options offered to Participants in the 457 Plan to have final approval by the Finance Director.

3. To meet with the Administrator to review the status of this Plan.

4. To perform other duties assigned to it by the Finance Director or the Majority Bargaining Agent (‘MBA’), and with the consent of the Director, the Committee may expand funds to fulfill its desires.

5. To perform such other duties as are set forth by the Plan document.


MEETING TIME AND LOCATION
The Committee shall meet four times a year as determined by the Committee’s membership.

COMPOSITION
The Committee is comprised of eight members. The Committee is composed of a member of the City Council; the director of the Finance Department or his or her designee; the director of Human Resources or his or her designee; the Mayor or his or her designee; and four Employee Participants appointed by HPOU or its ‘MBA’ (one or more of whom may be retired) in the Plan. The Mayor shall appoint Positions one and four, which are the member of the City Council and the Mayor’s designee. Positions five through eight are nominated and appointed by HPOU of its ‘MBA’, no action from the City Council is required.
The City Attorney or his or her designee shall serve as counsel to the Committee.

Position 1. A City Council Member.
Position 2. The Director of the Department of Finance or his or her designee.
Position 3. The Director of Human Resources or his or her designee.
Position 4. The Mayor or his or her designee.
Position 5. An Employee participant in the Plan (Employee participant may be retired).
Position 6. An Employee participant in the Plan (Employee participant may be retired).
Position 7. An Employee participant in the Plan (Employee participant may be retired).
Position 8. An Employee participant in the Plan (Employee participant may be retired).

TERM: The members in positions one through four of the Committee remain members so long as they occupy their official positions with the City or until they are removed by the Mayor.
CHAIRPERSON: The Committee must elect annually a chairperson and a vice-chairperson from among its members.


FINANCIAL ACCOUNTABILITY
Entity is NOT included in the financial reporting for the City of Houston.
