LEGAL AUTHORITY FOR CREATION AND OPERATION(City)
City of Houston, Code of Ordinances, Chapter 28, Article II, Division 4, Sections 28-113 and 28-114, and Chapter 28, Article III, Sections 28-125(d) through 28-125(f).
GENERAL POWER AND DUTIES
The panel of the hearing officials shall hear and decide appeals from the denial, suspension or revocation of permits to operate adult arcades, adult mini-theatres, and sexually oriented businesses.
MEETING TIME AND LOCATION
Meeting time will be determined on appeal filed with any officer or designee.
COMPOSITION
TOTA:: Up to 10 members. Appointed by the Mayor and confirmed by the City Council.
QUALIFICATIONS
An attorney licensed to practice law in the State of Texas.
HEARING PROCESS
The hearings are conducted pursuant to rules issued by the chief of police. Hearings are
conducted by each hearing official in rotation as appeals are filed. The hearing official
shall not have participated in any investigation or decision relating to the subject of the
hearing.
TERM: At the pleasure of the Mayor.
COMPENSATION: Shall serve without compensation
FINANCIAL ACCOUNTABILITY
Entity is NOT included in the financial reporting for the City of Houston.
