LEGAL AUTHORITY FOR CREATION AND OPERATION(City)
City of Houston, Code of Ordinances, Chapter 8, Article II, Division 1, Section 8-17.
GENERAL POWER AND DUTIES
1. The Automotive Board shall consider applications for the various automotive dealer's licenses as set forth in Chapter 8 of the Houston Code of Ordinances and shall approve or deny such applications.
2. The Automotive Board may revoke or suspend a license for just cause after a hearing.
3. The Automotive Board shall either approve or deny the application for salesman as set forth in Chapter 8 of the Houston Code.
MEETING TIME AND LOCATION
The board shall hold not less than one nor more than three regular meetings each calendar month, provided that additional meetings may be conducted if required in order to meet deadlines imposed by law or by any contract to which the city is a party. Meetings are to be located at the City Hall Annex Council Chamber, 900 Bagby St, Houston, Texas.
COMPOSITION
TOTAL: 11 members
Each of the eleven positions on the Automotive Board shall be appointed by the mayor and confirmed by the city council.
Position 2: Shall be filled by a used car dealer.
Position 3: Shall be filled by a wholesale parts and accessories dealer.
Position 4: Shall be filled by a new and used automobile retail parts dealer.
Position 5: Shall be filled by a service station or gasoline station operator.
Position 6: Shall be filled by a person who owns and operates a vehicle storage lot.
Position 7: Shall be filled by a person who is not related within the first or second degree by consanguinity or affinity to any person who holds any interest in or is employed by any automotive business of a type that is subject to regulation under this chapter and is situated in the county.
Position 8: Shall be filled by a person who owns and operates an automotive repair facility.
Position 9: Shall be filled by a person who owns and operates an automobile wrecking and salvage yard.
Position 10: Shall be filled by a member of the legal department of the city designated by the city attorney, who shall be an ex officio member only.
Position 11: Shall be the Chief of Police or his duly authorized representative assigned to the automobile dealers’ detail, who shall serve as secretary of the automotive board and shall be an ex officio member only.
COMPENSATION: Each member of the automotive board shall receive $25.00 per diem for his or her services while attending meetings of the automotive board. Each member of the board who is employed by the city shall receive the same compensation as other members of the board for attending those meetings not held during, or which continue beyond, his regular working hours. To the extent permitted by law, per diem payments to the board members shall be made out of the auto dealers' fund.
QUORUM: Five members of the automotive board (excluding ex officio members) present at any meeting shall constitute a quorum for the transaction of all business of the board, and a majority vote of those members of the board present at any meeting shall prevail.
TERM: Appointments to positions created hereunder shall be made on or before January second of each year and shall take effect on that date. Each member of the board shall serve for a term of one year and until his successor has been appointed and qualified. Any appointed member of the board shall be subject to discharge and removal from his or her position on the board at any time by the Mayor.
CHAIRPERSON: The Mayor shall designate the member to be chairperson of the board.
FINANCIAL ACCOUNTABILITY
Entity is NOT included in the financial reporting for the City of Houston.
