LEGAL AUTHORITY FOR CREATION AND OPERATION(Federal)
Older American Act of 1965, as amended by 42 USCA d 3001 et. al. (d 3026 (a)(6)(D)). 45 CFR Part 1321, Subpart C (45 CFR d 1321.57 - Advisory Council Composition).

GENERAL POWER AND DUTIES
The purpose of the Area Planning Advisory Council is to advise the Houston/Harris County Area Agency on Aging on matters relating to:
1. The development and administration of the area plan.
2. The conduct of public hearings.
3. The representation of interests of older persons.
4. The review of comment on all community policies, programs and action with respect to older persons.
In doing so, the Council shall provide the framework within which the City of Houston and Harris County shall survey health, education and social opportunities, resources, and facilities as they relate to available resources to meet the needs of older citizens and develop plans through appropriate action programs.





MEETING TIME AND LOCATION
The APAC shall meet the first Thursday of the month, except in July. The APAC shall meet at least six times a year. Special APAC meetings may be called at any time by the APAC Chairperson or by a majority vote of the Steering Committee.

COMPOSITION
TOTAL: 68 positions, 20 of which are held by Harrid County
Positions can be held by the following indivduals: 1. Older adults (at least 60 years old) broadly representing the geographic, ethnic, and socioeconomic distribution of the area’s population. 2. Representatives of older adults. 3. Locally-elected officials.

PROCESS (No residency requirement):
A. Appointments are made by Mayor, the Judge of Harris County Commissioners Court, each Commissioner or a Superintendent of an ISD.
B. In the event an appointing official does not make an appointment within ninety days, the vacancy may be filled by the Chairman of the APAC subject to the approval of the APAC. Such action may not be taken until thirty days after the appointing official has been notified in writing of the intention to make the appointment.
C. Failure to attend three consecutive meetings may, upon a majority vote of the council at a regular meeting, result in forfeiture of membership.
D. Should a vacancy occur for any reason, the appointing official shall be notified and asked to name a replacement to complete the unexpired term as set out in Article III, Section 5 (C).

QUORUM: A quorum shall be at least fifteen members of APAC, excluding elected officials.
TERM: The appointed person officially becomes a member of the APAC for a three year term following official appointment with the exception of Silver Haired Legislators who serve a two year term. Appointees shall serve as members of APAC until reappointed, replaced or notified that the membership has been terminated.
CHAIRPERSON: The chairperson is elected by the council’s membership. Serves a one year term and cannot serve more then three conseccutive terms in the same office.
COMPENSATION: Not specified.


FINANCIAL ACCOUNTABILITY
Entity is NOT included in the financial reporting for the City of Houston. Required to take an Ethics Course.
